Attorney’s Fees - Texas Workers Compensation

Attorney's fees are only paid when legal work is done on your case, and we only charge for reasonable and necessary legal work that we have performed. We submit our charges to the State who then reviews our charges and determines if they fall within their guidelines. After the State approves our fees, the State should send the approved fees to you for your review. If you do not dispute the fees the State orders the insurance company to begin deducting attorney’s fees from your weekly check at up to twenty-five percent of your check until they are paid. If your workers compensation permanently stops with attorney’s fees owing, you do not pay the balance. Since we are only paid if you are receiving compensation, we want you to receive compensation as long as you need it. On the other hand, the insurance company wants your Comp to stop at the earliest possible date. We want to protect your Comp check and your legal rights. "It’s better to pay an attorney 25% of your Comp than to keep 100% of nothing."

About the Author - Attorney Bill Ogletree is a fourth generation Houstonian who graduated from the University of Houston with a Bachelor of Arts Degree in Psychology in 1969 and from law school at the University of Houston with a Doctor of Jurisprudence Degree in 1976.
